Unless noted above, the attached terms and conditions apply to this quotation:

Please read thoroughly. Please note that the prices are US dollars and firm for 60 days from the date on this quotation, as long as the project/product is shipped within the same time period. Prices are subject to change after this time period. Payment terms are typically Net 30 days from invoice date depending on credit approval, unless otherwise noted. All taxes will be paid by the Buyer. Freight is ex-works (LyM factory), freight paid by customer. Any Buyer changes to the project/product quoted may cause cost/price implications to the Buyer. FOB: Hermosillo, Sonora, México.

Taxes: The Buyer will pay all sales, use, or other taxes imposed by any taxing authority with respect to product sales, other than taxes imposed on net income or personal property taxes.

Freight: EX-WORKS (LyM factory).  Freight paid by the Buyer and ownership of and risk of loss related to product(s) passes to the Buyer when the product leaves the LyM factory.

4. Pricing: All pricing will be US Dollars.  Prices on quotations are firm for 60 days from the date on the quote, unless otherwise stated, and the product is shipped within the same 60 day time period.  Product shipped after the 60 day time period is subject to price change.  Customers will be asked to reflect any price changes in a revision to their purchase order and re-submit to LyM as confirmation of acceptance.  LyM will not ship product until written acceptance from the buyer is received.

5. Changes or Cancellations:  Buyer changes to a purchase order and cancellations will be evaluated by LyM for cost implications and the Buyer will pay for all work in process, completed items, vendor costs, Administration, Engineering, or Drafting costs related to the change or cancellation.  In the case of a cancellation, if the project is restarted within 90 days, 75% of the Administration, Engineering, and Drafting costs incurred by the Buyer may be applied to the new order.  Ship date changes requested by the Buyer will be reviewed by LyM and the Buyer will be informed of any price changes as a result of the new date.  LyM will not ship product until written acceptance of the adjusted price from the buyer is received by LyM.

6. Shipping: Product will be shipped with standard LyM packaging/crating and tagged or marked with the LyM serial number, LyM part number, Buyer's PO number, Buyer's part number, and numbered boxes unless special shipping requirements are explicitly identified by the Buyer in advance of shipment and covered in an LyM quotation.  LyM will use commercially reasonable efforts to ship product on the date promised, but will not be liable for any loss or damage caused by delay in delivery.  LyM will inform the Buyer promptly if a delay is anticipated.

7. Warranty: LyM's General Warranty with any additional MESABI® product specific warranty will be the only warranty in effect.  Warranty details are available.

8. Trademarks:  LyM de Mexico S.A de C.V. trademarks or part numbers are not to be removed or adulterated.
